Waste Collection Haringey Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Haringey provides waste collection and related services to residential and commercial customers within our service area. By making a booking, confirming a quotation or using our services, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Service means any waste collection, rubbish clearance, recycling, bulky waste removal or related service provided by us.
Customer means the individual or business requesting and paying for the Service.
Waste means any items, materials or rubbish presented by the Customer for collection under the Service.
Service Address means the property or location where the Waste is to be collected.
We, us and our refer to Waste Collection Haringey as the service provider.
2. Scope of Service
We provide scheduled and one-off waste collection services within our designated service area. The Service may include general household waste, commercial waste, garden waste, recyclable materials and non-hazardous bulky items, subject to these Terms and Conditions and any applicable waste regulations.
The exact scope of the Service, including the type and estimated volume of Waste to be collected, the collection date and time window, and the applicable charge, will be confirmed during the booking process.
We reserve the right to refuse to collect certain items, including but not limited to hazardous waste, chemicals, asbestos, clinical waste, pressurised containers, fuel, gas bottles, and any items which we reasonably consider unsafe to handle or unlawful to transport or dispose of.
3. Booking Process
3.1 Making a Booking
Bookings may be made by telephone, email or online, subject to the methods we make available at the time. When you make a booking you must provide accurate information about:
the Service Address and access details, including parking restrictions;
the type of property and any relevant access limitations;
the type, approximate volume and nature of the Waste; and
any special requirements, such as time restrictions or building management rules.
3.2 Provisional and Confirmed Bookings
All bookings are subject to availability and our acceptance. We will confirm acceptance of a booking by issuing a booking confirmation. A binding contract arises when we send this confirmation or, where no confirmation is sent, when we attend the Service Address and commence the Service.
3.3 Changes to Bookings
If you need to amend the date, time or scope of the Service, you must notify us as early as possible. Changes are subject to availability and may result in an adjustment to the price. Where the volume or type of Waste differs from that described at the time of booking, we may revise the quotation or decline to collect certain items.
4. Quotations and Pricing
4.1 Quotations
We may provide quotations based on information supplied by you in advance, or following an assessment at the Service Address. Quotations are normally based on estimated waste volume, labour required, access conditions and disposal costs.
4.2 Price Adjustments
If upon arrival the actual Waste, access or other conditions differ significantly from those described at the time of booking, we may adjust the price to reflect the change. We will notify you of any change before proceeding. If you do not accept the revised price, we may cancel the Service and a call-out or cancellation charge may apply in accordance with these Terms.
4.3 Taxes and Additional Charges
All prices are stated exclusive of any applicable VAT or other taxes, which will be added at the prevailing rate where applicable. Additional charges may apply for congestion charges, parking fees, waiting time, out-of-hours work, or for items that incur higher disposal costs, such as mattresses or certain electrical goods. Any such charges will be notified to you as far as reasonably practicable before or at the time of collection.
5. Payments
5.1 Payment Methods
We accept payment by the methods we specify from time to time, which may include debit or credit card, bank transfer or cash. Business customers may be offered account terms at our discretion.
5.2 Time of Payment
Unless agreed otherwise in writing, payment is due in full on or before completion of the Service. We may require a deposit or payment in advance to secure a booking. Where account terms are agreed, invoices are payable within the period stated on the invoice.
5.3 Overdue Payments
If any amount is not paid when due, we may charge interest on the overdue sum at the statutory rate and may suspend further services until full payment is received. We also reserve the right to recover any reasonable costs incurred in enforcing payment, including debt recovery and legal fees.
6. Customer Obligations
6.1 Access and Parking
You must ensure that our staff and vehicles have safe, reasonable and lawful access to the Service Address at the agreed time, including suitable parking arrangements. Any parking charges, fines or penalties arising from inadequate information or arrangements provided by you may be charged to you.
6.2 Presentation of Waste
You must ensure that the Waste is accessible and presented in a safe and suitable manner. Heavy or bulky items should be reasonably accessible, and sharp or dangerous components should be secured or identified. You must not include prohibited or hazardous items in the Waste.
6.3 Authority to Arrange Removal
By booking the Service, you confirm that you are the owner of the items to be removed or have the full authority of the owner to request their removal and disposal. You agree to indemnify us against any claim by a third party alleging that the removal of the Waste was not authorised.
7. Cancellations and Rescheduling
7.1 Customer Cancellations
If you wish to cancel or reschedule a booking, you must notify us as soon as possible. Where you cancel with sufficient notice, as specified at the time of booking, any deposit paid may be refunded or carried forward, subject to our cancellation rules. If you cancel with inadequate notice, fail to provide access, or are not present where your attendance is required, we may charge a cancellation or call-out fee to cover our reasonable costs.
7.2 Our Right to Cancel
We reserve the right to cancel or postpone a booking at any time due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather, road closures or compliance with legal obligations. In such cases, we will endeavour to reschedule the Service to a mutually convenient time. We may also cancel the Service where we reasonably believe it would be unsafe, unlawful or impracticable to proceed, including where hazardous materials are present or access is severely restricted.
8. Performance of the Service
We will use reasonable skill and care in the performance of the Service. Any collection times provided are estimates and not guaranteed, but we will use reasonable efforts to attend within the agreed time window. We are not liable for delays caused by traffic, adverse weather, access issues or other factors outside our reasonable control.
We will remove Waste from within or around the Service Address as agreed. Unless otherwise stated, we are not responsible for cleaning, sweeping or remedial works beyond reasonable tidying upon completion of the removal.
9. Waste Handling and Regulations
9.1 Legal Compliance
We will transport and dispose of Waste in accordance with applicable UK laws and regulations relating to waste management and environmental protection. This may include transfer of Waste to licensed facilities, recycling centres or authorised treatment plants.
9.2 Waste Transfer and Documentation
Where required, we will complete appropriate waste documentation confirming the transfer of Waste from the Customer to us or to a subsequent authorised carrier. By using our Service, you consent to such documentation being completed on your behalf where necessary.
9.3 Prohibited Waste
You must not present hazardous or unlawful Waste for collection. If such items are discovered, we may refuse to collect them, charge additional fees for safe handling and disposal, or require you to arrange a specialist service. We may also notify the relevant authorities if legally required.
10. Liability and Insurance
10.1 Our Liability
We will exercise reasonable care when carrying out the Service. However, we are not liable for:
pre-existing damage, defects or wear and tear at the Service Address or to items being removed;
damage arising from poorly constructed or inherently fragile items;
any indirect or consequential loss, including loss of profit, loss of business or loss of opportunity;
loss or damage arising from inaccurate or incomplete information provided by you.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be excluded or limited by law.
10.2 Limitation of Liability
Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the Service, whether in contract, tort or otherwise, shall not exceed the amount paid or payable by you for the specific Service giving rise to the claim.
10.3 Customer Responsibility
You are responsible for securing or removing valuable, fragile or sensitive items from the vicinity of the work area before the Service is carried out. We will not be liable for accidental damage to such items that were not reasonably visible or brought to our attention.
11. Complaints
If you have any concerns about the Service, you should notify us as soon as possible, and in any event within a reasonable time after completion of the Service. We will investigate your complaint and, where appropriate, may offer a remedy such as a partial refund, re-attendance or other reasonable solution, at our discretion and in line with our legal obligations.
12. Data Protection and Privacy
We may collect and process personal data such as contact details, Service Address information and payment details in order to provide the Service and manage our relationship with you. We will handle such data in accordance with applicable data protection laws and only use it for legitimate business purposes, including service delivery, billing, customer support and compliance with legal obligations.
13. Intellectual Property
All content, branding and materials used by us in connection with our services, including logos, service descriptions and promotional materials, remain our property or that of our licensors. Nothing in these Terms grants you any rights in such intellectual property other than the right to use our services in accordance with these Terms.
14. Variations to These Terms
We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to the Service we provide to you. Any significant changes will be made available on request or through our usual communication channels.
15. Severability
If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted so far as necessary, and the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and us in relation to the Service and supersede any prior discussions or understandings. You acknowledge that you have not relied upon any statement or representation not expressly set out in these Terms.
17. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service, including any non-contractual disputes or claims.
By placing a booking or using our waste collection services, you confirm that you have read, understood and agree to these Terms and Conditions.
